These Terms of Service ("Terms") govern your use of the FameFurge website and services (the "Service"), operated by Next Level Consulting Services, LLC ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent that you meet these requirements and have the authority to agree to these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Subscriptions, Credits & Billing

  • Plans: We offer subscription plans billed monthly through our payment provider (Base44 Payments / Wix). Subscription fees are charged in advance on a recurring basis until canceled.
  • Credits: AI generation features consume credits. Each plan includes a monthly credit allowance; unused credits do not roll over unless stated otherwise. Additional credits may be purchased as one-time top-off packs.
  • Auto-renewal & cancellation: Subscriptions auto-renew each billing cycle. You may cancel at any time through your account or payment provider; cancellation takes effect at the end of the current billing period.
  • Refunds: Payments are generally non-refundable except where required by applicable law. Refund requests may be considered on a case-by-case basis via our contact page.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, harmful, fraudulent, or abusive purpose.
  • Generate content that infringes the intellectual property or privacy rights of others, or that is defamatory, harassing, or otherwise prohibited.
  • Attempt to access, disrupt, or reverse-engineer the Service, its systems, or its integrations.
  • Resell, sublicense, or redistribute access to the Service without our written permission.
  • Use automated tools to scrape or overload the Service.

5. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate content suggestions, scripts, posts, carousels, and videos. All AI-generated content is provided for informational and creative purposes only. We make no guarantees regarding the accuracy, originality, legality, or performance (including "virality") of generated content. You are solely responsible for reviewing, editing, and verifying any content before publishing it. We are not liable for the consequences of using AI-generated content.

6. Your Content

You retain ownership of the content you create using the Service. By using the Service, you grant us a limited license to process your inputs as necessary to provide the Service to you. You are responsible for ensuring you have the rights to any material you submit.

7. Intellectual Property

The Service, including its design, software, branding, and features, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology.

8. Third-Party Platforms & Links

The Service may reference or integrate with third-party social media platforms and services. We are not affiliated with or endorsed by those platforms, and their use is subject to their own terms and policies. Links to third-party sites are provided for convenience and we are not responsible for their content or practices.

9. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising out of or related to the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any rights of a third party.

11. Termination

We may suspend or terminate your account or access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Next Level Consulting Services, LLC operates, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
